
ElektroG
Since 23rd March 2005 the Electrical and Electronic Equipment Act (ElektroG) has been in force. Thus the taking back and environmentally compatible disposal or utilisation of electronic appliances and components has been regulated by the legislator.
From 1st July 2006 the rules and regulations of the RoHS Directive
included in
§ 5 “Substance Prohibitions”, ElektroG, will apply as
well.
After 1st July 2006 products which are not in conformity with
this directive and
subsequently contain certain substances may
neither be sold by the manufacturer
nor acquired by dealers.
Therefore manufacturer and dealer have the same interest in being able to prove
to their customers that their products are in agreement with the RoHS Directive.

Note: A manufacturer according to the meaning of the ElektoG is anyone, irrespective of the selling method, including means of remote communication according to the meaning of § 312b, paragraph 2, of the German Civil Code, who:
- Commercially manufactures electrical and electronic equipment under his brand name and puts them into the stream of commerce within the scope of this Act for the first time
- Commercially resells equipment of other suppliers under his brand name within the scope of this Act, in which context the reseller is not to be considered a manufacturer as long as the brand name of the manufacturer according to point 1 appears on the equipment
- Commercially imports and puts into the stream of commerce electrical and electronic equipment for the first time within the scope of this Act or exports them to any other member state of the European Union and immediately supplies them to a consumer there. Over and above that the seller will also be considered a manufacturer if he is guilty of offering for sale new electrical and electronic equipment of non-registered manufacturers.
